The Association of Oral and Maxillofacial Surgeons of India has moved the Bombay High Court, filing an intervention application in response to a Public Interest Litigation (PIL) challenging the guidelines issued by the Dental Council of India (DCI) for hair transplant procedures. The PIL, filed by the Dynamic Dermatologist and Hair Transplant Association, seeks action against oral and maxillofacial surgeons who are alleged to be performing aesthetic and hair transplant surgeries despite lacking the required qualifications.
In an interim application submitted on December 5, through advocates Harekrishna Mishra and Arun D. Mishra, the Association argued that it is a necessary party in the ongoing PIL. The application claims the PIL was filed with insufficient research and a “malafide intent” to restrict oral and maxillofacial surgeons from entering the field of hair transplant surgery. The Association requested to be made a party to the case and to have its views heard in court.
The Association contends that the claims made in the PIL are unfounded, stating that the curriculum of oral and maxillofacial surgeons includes surgeries that are far more complex and intricate than hair transplant procedures, which, according to the Association, are primarily superficial and limited to the scalp. The intervenors further argued that oral and maxillofacial surgeons are trained in performing far more challenging procedures, making them suitably qualified for such aesthetic surgeries.
The PIL, filed in 2023, challenges the guidelines issued by the DCI on December 6, 2022, which allowed oral and maxillofacial surgeons to perform aesthetic and hair transplant surgeries. The petitioners argue that these surgeons, trained as dentists, lack the necessary education or expertise in hair transplant techniques and should not be permitted to perform such procedures. The PIL calls for the revocation of the DCI’s guidelines and legal action against practitioners it deems “unqualified” in the field of hair transplant surgeries.
The Bombay High Court is expected to hear the intervention application and the PIL on December 11.
